Privacy Notice Effective 25th May 2018
Introduction

Wahl (UK) Ltd are committed to protecting your privacy. We want you to be fully informed about your rights, and how we use your data.

 

This Privacy Notice will outline the types of personal data we may collect about you when you interact with us and how we store, handle and protect that data. We will not sell, share, or rent this information to others other than as disclosed in this statement.

 

We may need to update this Privacy Notice from time to time so we recommend that you check back periodically. This notice refers to, without limitation, all online and offline collections of all types of personal data.

 

You may check, amend or request deletion of your personal details by e-mailing data.protection@wahl.co.uk or writing to us.

Lawful bases of data processing

According to the lawful bases for processing set out in the GDPR, we may collect and process your personal data under the following lawful bases:

 

Consent – You may give us clear consent to process your data for a specific purpose

E.G. Signing up to receive our newsletters or entering competitions

 

We will only collect data that is necessary to provide you with the best customer experience.

 

Contract – We may require personal data to comply with contractual obligations.

E.G. We will need to collect your address details to deliver any purchases, and we will be required to pass them to our courier. (Please see details in the ‘Who’ section).

 

Legal obligation - We may need to collect personal data to comply with the law.

E.G. When you exercise your rights under data protection law and make requests. For compliance with legal and regulatory requirements and related disclosures. For establishment and defence of legal rights. For activities relating to the prevention, detection and investigation of crime. To verify your identity, make credit and fraud prevention checks.

 

Legitimate interest

In specific situations, we may require your data to pursue our legitimate interests in a way which might reasonably be expected as part of running our business and which does not materially impact your rights, freedom or interests.

When we collect data

We will collect your data in the following circumstances:

 

When you visit any of our websites and create an account to make a purchase.


When you make an online purchase and check out as a guest (we will collect data necessary to complete the transaction). 


When you create an account with us.


When you purchase a product or service in store or by phone but don’t have (or don’t use) an account. 


When you engage with us on social media. 


When you contact us by any means with queries, complaints etc. (Including filling out a returns form, using the ‘Contact Us’ page on our website(s)).


When you enter prize draws or competitions.


When you book to attend an event, for example an Academy Course.


When you choose to complete any surveys we send you or participate in any other market research


When you comment on or review our products and services. Any individual may access personal data related to them, including opinions.


When you’ve given a third-party permission to share with us the information they hold about you.


When you interact with us as a business customer, supplier or business partner, etc.

What data we collect

We collect the following information:

 

If you have a web account with us: your name, gender, date of birth, billing/delivery address, orders and receipts, email and telephone number.

 

We collect notes from our conversations with you, details of any complaints or comments you make, details of purchases you made, items viewed or added to your basket, voucher redemptions, products you show interest in, web pages you visit and how and when you contact us.

 

Details of your visits to our websites and which site you came from to ours (including but not limited to your IP address).

 

If you consent to receive newsletters/competitions, we will collect your name and email address.

 

Information gathered by the use of cookies in your web browser (A Cookie is a piece of data containing information about the user which may be stored on the user’s hard drive. We do not use persistent Cookies which are stored on your computer, but we do use temporary per session, Cookies for tracking your searches, shopping basket items and checkout details. If you have your per session cookies turned off or have set the highest level of security in your browser settings you may be unable to purchase items from our site).

 

Your social media username, if you interact with us through those channels, to help us respond to your comments, questions or feedback.

 

If you are a product tester, we collect your name, address and telephone number.

 

If you are a business customer, supplier or business partner we may collect your name, email address, telephone number and IP address

 

How we use data

We use data in the following ways:

 

Customer experience: We use this data to offer you promotions, products and services that are most likely to interest you.

 

With your consent, we will use your personal data, preferences and details of your transactions to keep you informed by email, web, text and telephone about relevant products and services including tailored special offers, discounts, promotions, events, competitions and so on.

 

To process any orders that you make by using our websites or in store. If we don’t collect your personal data during checkout, we won’t be able to process your order and comply with our legal obligations.

 

To respond to your queries, refund requests and complaints. We may also keep a record of this for any future communications.

 

To send you communications required by law or which are necessary to inform you about our changes to the services we provide you. For example, product recall notices and legally required information relating to your orders. These service messages will not include any promotional content and do not require prior consent when sent by email.

 

To protect our business and your account from fraud and other illegal activities. This includes using your personal data to maintain, update and safeguard your account if you have credit terms with us.

 

To administer any of our prize draws or competitions which you enter, based on your consent given at the time of entering.

 

To comply with our contractual or legal obligations to share data with law enforcement.

 

To send you survey and feedback requests to help improve our services. These messages will not include any promotional content.

How long we keep data for

 

We will not keep your personal information for any purpose for longer than is necessary and will only retain the personal information that is necessary in relation to the purpose. We are also required to retain certain information as required by law or for as long as is reasonably necessary to meet regulatory requirements, resolve disputes, prevent fraud and abuse, or enforce our terms and conditions.


Where you are a prospective customer and you have expressly consented to us contacting you, we will only retain your data (a) until you unsubscribe from our communications; or, if you have not unsubscribed, (b) while you interact with us and our content; or (c) for 2 years from when you last interacted with us or our content.

 

In the case of any contact you may have with our customer services team, we will retain those details for as long as is necessary to resolve your query and for 6 months after the query is closed.

How we protect data

Wahl (UK) Ltd promises to treat your data with the utmost care and take every appropriate step to protect it.

 

As part of this, we secure access to all transactional areas of our websites and apps using ‘https’ technology.

 

Access to your personal data is always password-protected, and sensitive data (such as payment card information) is secured by SSL encryption.

 

Wahl (UK) Ltd are PCI DSS compliant.

 

We regularly monitor our system for possible vulnerabilities and attacks, and we carry out penetration testing to identify ways to further strengthen security.

 

Who we share data with

We sometimes share your personal data with service providers, business providers and other trusted third parties.

 

For example, delivery couriers, testing companies, IT and communications service providers, data management support partners, payment gateways and other third parties bearing a necessary relationship for Wahl (UK) Ltd to provide its services.

 

In addition to this, to help us to provide you with the best customer experience, we may share data with:

 

Direct marketing companies who help us manage our electronic communications with you (e.g. MailChimp).

 

Facebook, Google, Instagram, YouTube, to show you products that might interest you while you’re browsing the internet. This is based on either your marketing consent or your acceptance of cookies on our websites.

 

Other members of the Wahl Group, such as website tracking trends.

We don’t share your data with third parties for their own purposes, unless we are legally required to:

 

For fraud management, we may share information about fraudulent or potentially fraudulent activity in our premises or systems. This may include sharing data about individuals with the relevant law enforcement bodies.

 

We may also be required to disclose your personal data to the police or other enforcement, regulatory or Government body, in your country of origin or elsewhere, upon a valid request to do so.

Your rights

Under GDPR, you have the right to:

Have inaccuracies corrected

 

Have information permanently deleted

Prevent automated decision-making and profiling

 

You can contact us to request to exercise these rights at any time. To ask for your information to be amended please update your online account or contact data.protection@wahl.co.uk. If we choose not to action your request we will explain to you the reasons for our refusal.

 

Your right to withdraw consent

 

You have the right to change your mind at any time and withdraw consent. To stop direct marketing communications from us:

 

Click the ‘unsubscribe’ link in any email communication that we send you. We will then stop any further emails from that particular division.

 

If you have an account, log in into your account, visit the ‘My Account’ area and update your preferences.

 

Please note that you may continue to receive communications for a short period after changing your preferences while our systems are fully updated.
